FieldHire AI Terms of Use for Job Applicants

Service Provider: AbleJ Co., Ltd.

These Terms of Use (the "Terms") set forth the rights, obligations, and responsibilities that apply when job seekers applying to employers in the United States (each, an "Applicant") use FieldHire AI (the "Service"), an AI-powered recruitment support platform provided by AbleJ Co., Ltd., a company incorporated under the laws of the Republic of Korea (the "Company").

The Service is a technology platform designed to support employers' hiring operations. It does not itself decide whether an Applicant is hired, nor does it guarantee employment.

The terms used in these Terms are defined as follows:

1. "Employer" means a company or organization in the United States that has adopted FieldHire AI to conduct its hiring process for job seekers.

2. "Applicant" means an individual who submits a résumé to apply for a position with an Employer or who participates in a hiring process using FieldHire AI.

3. "AI Résumé Analysis" means a function that uses artificial intelligence technology to extract and classify the contents of an Applicant's résumé, analyze its relevance to job requirements, and provide reference information to the Employer.

4. "AI Interview" means an interview support function that uses artificial intelligence technology to present interview questions and to collect, transcribe, and analyze the Applicant's responses.

5. "Video Interview" means a form of AI Interview that collects footage of the Applicant speaking and the Applicant's voice through a camera and microphone.

6. "Behavioral Observation Data" means objectively observable information during a Video Interview, such as observable movements, changes in gaze direction, facial and head movements, and temporal changes related to speech.

7. "Behavioral Supplementary Indicators" means supplementary reference information, derived from Behavioral Observation Data, that identifies segments or matters in a particular Applicant response that may warrant further review.

8. "Personal Information" means information that identifies or may relate to a specific individual, including résumés, contact details, voice, video, interview responses, and related analysis results.

8. Video-based AI Interview functionality (planned for the future)

9. Generation of Behavioral Observation Data and Behavioral Supplementary Indicators in Video Interviews (planned for the future)

10. Provision of per-Applicant interview results and analysis reports to Employer personnel

② The video-related functions described in Paragraph 1, Items 8 and 9 are planned future expansions distinct from the functions currently provided. Before actually providing such functions, the Company will put in place the necessary privacy notices, separate consent procedures, and related legal and technical safeguards.

③ The functions actually made available to an Applicant may vary depending on the relevant Employer's service settings and the hiring process in which the Applicant participates.

④ The Company does not guarantee the same evaluation results, interview opportunities, or hiring outcomes to all Applicants.

① The Employer is responsible for recruiting Applicants, setting hiring requirements, screening Applicants, conducting interviews, and making final hiring decisions.

② As a general rule, the Employer determines the purposes and principal means of processing Personal Information in connection with its hiring process.

③ As a general rule, the Company acts as a technology service provider or a processor (service provider) that processes Personal Information in accordance with its contract with, and the lawful instructions of, the Employer.

④ Where the Company processes Personal Information for its own independent purposes, such as system security, prevention of unauthorized access, or compliance with legal obligations, the Company may bear separate responsibility for such processing under applicable law.

⑤ When using AI analysis results, the Employer must comply with applicable employment laws, anti-discrimination laws, and regulations governing AI-based hiring assessments.

⑥ The respective responsibilities of the Company and the Employer are determined by the actual Personal Information processing activities and applicable law, and no legal responsibility is waived or transferred by these Terms alone.

① Résumés submitted by Applicants, or lawfully provided to the Company by Employers, may be processed to support the hiring process.

② The Company may extract or analyze work experience, education, skills, qualifications, and other job-related information contained in résumés.

③ AI analysis is intended to help the Employer efficiently review an Applicant's job-related qualifications and experience.

④ Analysis results generated by AI may contain errors, omissions, or biases.

⑤ The Employer determines how AI analysis results are used and whether an Applicant proceeds in the hiring process. However, the Company and the Employer must each comply with the AI-related laws and anti-discrimination obligations applicable to them.

⑥ In accordance with applicable law, an Applicant may request that the Employer correct inaccurate information, explain the evaluation method, or honor other rights.

① Applicants participating in an AI Interview will be informed in advance that their voice and spoken content may be collected and processed during the interview.

② At the Employer's direction, the Company may process the following information:

1. Audio recordings of the Applicant's voice

2. Interview questions and spoken content

3. Interview responses converted from speech to text

4. Interview duration and session information

5. AI analysis results regarding response content

③ Voice data is used to record interview responses, produce transcriptions, analyze job-related responses, and support the Employer's review of interviews.

④ Where required by law, the Company will obtain separate prior consent for interview recording and AI analysis.

⑤ An Applicant may decline to provide any consent required by law and may contact the Employer regarding alternative interview methods or reasonable accommodations.

① The Company may in the future expand its AI Interview functionality to offer Video Interviews, which collect both video and audio of the Applicant while speaking.

② Information that may be collected in a Video Interview includes:

1. Interview video showing the Applicant's face, upper body, and the like

2. Audio recorded together with the video

3. Spoken content and transcription results

4. Observable movements and changes in gaze direction during the interview

5. Facial and head movements, speaking time, and other Behavioral Observation Data disclosed in advance

③ The purpose of processing Behavioral Observation Data is to identify segments or matters in an Applicant's responses that may warrant further review, and to help the Employer more fully understand the content and context of those responses.

④ Behavioral Supplementary Indicators shall not be used to determine or conclude any of the following:

1. Whether the Applicant's statements are true or false

2. The Applicant's honesty or moral character

3. The Applicant's likelihood of criminal conduct or propensity for misconduct

4. The Applicant's mental health condition or disability status

5. Whether the Applicant is hired or rejected

⑤ The Company does not represent that the truthfulness of statements can be reliably determined from behaviors such as facial expressions, gaze, or gestures alone.

⑥ Behavioral Supplementary Indicators are not designed to be used as an independent pass/fail criterion or as grounds for automatic rejection. If an Employer uses them to evaluate Applicants, the Employer must separately assess the lawfulness, job-relatedness, and discrimination risks of such processing.

⑦ Before actually introducing Video Interview functionality, the Company will inform Applicants of the data collected, the analysis methods, the purposes of use, the retention period, and related rights, and will obtain any required separate consent.

⑧ The Company will comply with the restrictions, prohibitions, audit, explanation, and alternative-process requirements imposed by applicable law with respect to Video Interviews and Behavioral Supplementary Indicators.

① As a general rule, the Company processes Applicants' video and audio only to the extent necessary to support the hiring process.

② The basic Service described in these Terms is not intended to create facial recognition templates or voiceprints for identifying individuals, or to use them to biometrically verify an Applicant's identity.

③ The Company does not use video or audio to infer emotional states, mental health, disability, race, or other sensitive attributes for hiring evaluation purposes.

④ If a separate biometric function is introduced in the future, the Company will review its lawfulness and put in place the necessary separate notices, consents, and safeguards.

① Analysis results provided by AI are information intended to support the Employer's work.

② The Employer makes the final decision on whether to hire an Applicant.

③ The Company does not guarantee an Applicant's employment, advancement through the hiring process, or any particular evaluation result.

④ The Company will not present AI results as more accurate or definitive than they actually are, and will appropriately inform the relevant parties of known technical limitations and the possibility of errors.

⑤ The mere fact that the final decision-maker is a human does not exclude the application of relevant AI hiring regulations or anti-discrimination laws.

① Specific matters regarding the collection, use, retention, sharing, and deletion of Personal Information are governed by the separate FieldHire AI Privacy Policy.

② Applicants may review the Privacy Policy, and any separate consent required by law will be requested individually.

③ The Company does not use Applicants' résumés, voice, video, or interview analysis results for advertising purposes unrelated to the relevant hiring process.

④ As a matter of principle, the Company does not use job seekers' Personal Information to train general-purpose AI models. If use for a separate training purpose becomes necessary in the future, the Company will separately review the lawfulness of such use and the applicable contractual and consent requirements.

① The retention period for Personal Information is determined with consideration of the Employer's lawful retention policy, the contract between the Company and the Employer, and applicable law.

② The Company deletes or de-identifies Personal Information in accordance with applicable law and the lawful instructions of the Employer.

③ Requests for deletion of Personal Information may be limited by statutory record-retention obligations, legal disputes, and other lawful grounds for retention.

④ Deletion of Video Interview data is subject to the separate legal deadlines and requirements applicable in the relevant state or locality.

① An Applicant who has difficulty using the AI Interview or Video Interview format due to a disability or other legally protected reason may request a reasonable accommodation from the Employer.

② The Employer will review such requests in accordance with applicable law and, where necessary, provide an appropriate alternative interview process.

③ The Company will cooperate, to the extent technically reasonable, to enable the Employer to handle such requests.

Applicants shall not engage in any of the following:

1. Impersonating another Applicant or a third party

2. Submitting another person's Personal Information without authorization

3. Circumventing or compromising the Service's security features

4. Distributing malicious software or interfering with the operation of the Service

5. Using the Service for unlawful purposes unrelated to the hiring process

The Company may respond to such violations in accordance with applicable law and contract.

① The Company may modify the Service as necessary for technical or operational reasons.

② When introducing functions that materially affect the processing of Personal Information, such as Video Interviews and Behavioral Supplementary Indicators, the Company will revise the relevant notices and obtain any required consent before implementation.

③ The Company will not retroactively apply new purposes of processing Personal Information without the notice required by applicable law.

① The Company provides the Service with reasonable care in accordance with applicable law.

② The Company does not guarantee the complete accuracy of AI analysis results or any particular hiring outcome.

③ Nothing in these Terms limits any privacy rights, anti-discrimination rights, or rights to legal remedies that cannot be excluded under applicable law, or any legal liability of the Company.

① The Company may amend these Terms in response to changes in applicable law or the Service.

② When amending these Terms, the Company will announce the effective date and the principal changes through the Service interface or other means.

③ Changes that require additional legal consent will take effect only after the Applicant's separate consent has been obtained or other legally required measures have been completed.

The governing law and dispute resolution procedures for these Terms will be finalized following a legal review of the structure of service delivery in the United States and the applicable laws.

In no event shall these Terms limit any mandatory provisions or non-waivable rights of Applicants under applicable U.S. federal, state, or local law.
